1. What the service is
GapScope UK (the "Service") is a business-intelligence tool. It searches the public web (via third-party search and crawling APIs), identifies UK businesses and business social-media accounts, extracts information those businesses have themselves published (website, trading address, business phone / WhatsApp, business email, social links, published follower counts) and calculates indicative "Digital Gap" scores. It also provides tools to organise that data and to open your own email, WhatsApp, SMS or phone application with a pre-filled message.
The Service is intended solely for business-to-business (B2B) lead research and marketing by businesses. It is not a consumer product and it is not a credit-reference, background-check, employment-screening or tenant-screening service.
2. Eligibility and accounts
- You must be at least 18 and acting in the course of a business, trade or profession.
- You are responsible for keeping your login secure and for everything done under your account.
- Each account holds its own private campaigns, leads, directory and outreach history; you may not share one seat between several people unless your plan includes multiple seats.
- We may suspend or close accounts that breach these Terms or the Acceptable Use Policy.
3. Plans, trials and billing
Current plans:
- Free demo — free — up to 100 businesses per web campaign, 25 social accounts per run.
- Pro — £49 per month — up to 500 businesses per web campaign, 100 social accounts per run.
- Agency — £149 per month — up to 500 businesses per web campaign, 100 social accounts per run, 5 seats.
- Free demo is provided "as available" and may be limited, changed or withdrawn at any time.
- Paid plans are monthly subscriptions billed in advance in pounds sterling. Prices exclude VAT where applicable.
- Payments are processed by Stripe. We never see or store your full card number. By subscribing you also agree to Stripe's terms.
- Subscriptions renew automatically each month until cancelled. You can cancel at any time from the Billing page; access continues until the end of the paid period.
- While billing is in demo mode (shown on the Billing page) no payment is taken and plan upgrades are simulated for evaluation only.
- We may change prices with at least 30 days' notice by email; the new price applies from your next renewal after the notice period.
- Refunds are governed by the Refund & Cancellation Policy, which forms part of these Terms.
4. Fair use and usage limits
Plan limits (businesses per campaign, social accounts per run, seats, background queue) are enforced technically. We may also apply reasonable rate limits to protect the platform and our upstream providers. Automated abuse, scraping of the Service itself, or reselling raw access to the Service is prohibited.
5. Your responsibilities as a data controller
When you run a campaign you decide the purpose (finding businesses to offer your services to) and the means. Under UK GDPR you are the controller of any personal data contained in the results (for example the name in a sole trader's business name or a business mobile number). We act as your processor for storing and displaying that data. You agree to:
- Rely on a lawful basis — normally legitimate interests for B2B marketing — and be able to document your assessment.
- Comply with the Privacy and Electronic Communications Regulations (PECR) when sending emails, SMS or WhatsApp messages: corporate subscribers may generally be contacted; sole traders and partnerships require consent or an existing relationship for electronic marketing; live calls must be screened against the Telephone Preference Service (TPS/CTPS).
- Identify yourself in every message, provide a simple opt-out, and honour opt-outs immediately.
- Delete or stop using data about anyone who objects, and fulfil any subject-access or erasure request you receive.
- Not use the data for harassment, unsolicited consumer marketing, discrimination, or any purpose unrelated to legitimate B2B outreach.
The Privacy Policy sets out the data-processing terms that apply between us for this purpose.
6. Accuracy of results — important
- Results are extracted automatically from third-party web pages. We do not invent, infer or "enrich" contact details: every value is shown with the sentence it came from. Even so, websites go out of date, numbers get reassigned and businesses close.
- "Digital Gap", SEO, trust and priority scores are indicative heuristics, not audits or professional advice.
- A search that returns zero verified results is a correct outcome, not a defect.
- You must verify any information before relying on it commercially and before contacting anyone.
7. Third-party services
The Service depends on third parties including Exa (web search and content retrieval), Stripe (payments), Lovable Cloud (hosting, database, authentication, email) and Google (sign-in). Their availability, pricing and policies are outside our control. Data you view on platforms such as Instagram, Facebook, TikTok or LinkedIn remains subject to those platforms' terms; you must not use the Service in a way that breaches them.
8. Intellectual property
- We own the Service, its software, design, scoring methodology and branding. You receive a non-exclusive, non-transferable licence to use it for your internal business purposes for the duration of your plan.
- You own the campaigns you configure, notes you write and exports you download, subject to third-party rights in the underlying public information.
- You must not copy, reverse-engineer, resell, white-label or build a competing dataset from the Service without our written consent.
9. Availability, support and changes
We aim for high availability but do not guarantee uninterrupted service; background campaigns may pause during maintenance or provider outages and will resume automatically where possible. Support is by email at support@gapscope.uk. We may improve or change features; if a change materially reduces the functionality of a paid plan you may cancel and claim a pro-rata refund under the Refund Policy.
10. Disclaimer of warranties
Except as expressly stated, the Service is provided "as is" and "as available". To the fullest extent permitted by law we exclude all implied warranties, including accuracy, completeness, fitness for a particular purpose and that use of the results will comply with the laws applicable to your business or produce any commercial outcome.
11. Limitation of liability
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded.
- We are not liable for loss of profit, revenue, business, goodwill, data, or for any indirect or consequential loss.
- We are not liable for regulatory fines, claims or complaints arising from how you use or communicate with the leads, which is your responsibility under section 5.
- Our total aggregate liability arising from or related to the Service in any 12-month period is limited to the fees you paid to us in that period (or £100 if you are on the free plan).
12. Indemnity
You will indemnify us against claims, fines, losses and reasonable legal costs arising from your breach of section 5 (data protection / marketing law), the Acceptable Use Policy, or any third-party platform terms.
13. Termination
- You may close your account at any time from the Profile page or by emailing us. Closing does not automatically refund the current period except as stated in the Refund Policy.
- We may suspend or terminate for material breach, non-payment (after 7 days' notice), unlawful use, or if required by a provider or regulator.
- On termination your data is deleted within 30 days unless we are legally required to retain it. Export anything you need beforehand.
14. Complaints and disputes
Email support@gapscope.uk with "Complaint" in the subject. We acknowledge within 2 working days and aim to resolve within 14 days. If unresolved, either party may bring proceedings in the courts of England and Wales. Consumers (who should not normally be using this B2B service) retain any non-excludable statutory rights.
15. General
- Governing law: the laws of England and Wales.
- Changes: we may update these Terms; material changes are notified by email or in-app at least 14 days before they take effect. Continued use after that date is acceptance.
- Entire agreement: these Terms, the Privacy Policy, Refund Policy, Acceptable Use Policy and Cookie Policy are the whole agreement.
- Severability & waiver: invalid clauses are severed; failure to enforce is not a waiver.
- Assignment: you may not transfer your account; we may assign to a successor of the business.
